Freezing Out the Competition
Yesterday, Federal Judge Royce Lamberth issued an explosive ruling (in an admittedly narrow world) regarding federal funding of embryonic stem cell research.
The ruling and the plaintiffs behind it were particularly interesting, as you can read in my note for the American Spectator:

How do you justify NASA? Answer that question, and you answer this one. Our investments in raw science and related military research have, on balance, produced the second-highest ROI in history (we're using one!) -- buying a Congressman or Senator is far and away the best investment anyone could make.
You could be a purist and say that it isn't there, but if you prevailed, do you really think that the Constitution wouldn't be amended in a matter of weeks? Law adapts to meet societal needs.
Congress, the President (remember the "unitary executive") and the federal courts (judicial activism) have been constructively re-writing the Constitution for two centuries. Do they have the raw legal authority to do so? No. Are they going to get away with it? Bet on it.
